That Obstruction You See …

Opinions are like a certain body part.....everybody has one.

Here's my thought for what it is worth. This is both a nightmare and an opportunity for the President. I think he will nominate a strong left winger, one that he knows that the current Senate would never approve. He then has upcoming cases decided by an 8 person Supreme Court where he is at worst 50/50. He also gets a very strong election year issue for Hillary to beat the voters over the head with. Both situations would seem to work for him well.

What are the odds that Barack could nominate someone that the Senate would confirm? About the same as Hillary passing a lie detector test.

I disagree because it is in Obama’s interest to nominate a moderate now that the Republicans have overplayed their hand. It makes him look reasonable and willing to compromise. Plus, the Democrats can campaign for 11 months on Republicans being obstructionists and violating the constitution. If the Republican’s don’t move the nomination forward because they say, “they want the voters to decide,” it opens the door for the new Democrat President to appoint someone very liberal because Republicans have committed to moving that nominee forward by leaving it in the voters’ hands. It is a win win for the Democrats. Wait until that first 4-4 decision gets handed down on unions, abortions or Obamacare and watch conservative voters squeal like stuck pigs.

As to the 50/50, Obama is better than 50/50 because of how ties are handled in the Supreme Court. Any way you look at it, the Supreme Court no longer has a conservative majority and that will have a major impact on how cases are decided. It really is in the conservative’s best interests to work with Obama.The longer they drag this out the more liberal the eventual Justice will be.
A 4-4 draw means that whatever the ruling was that was on appeal is upheld.
Having an eight person divided Supreme Court flies in the face of the triad of Governance that the Founding Fathers envisioned.
So much for the claim of honoring the Originalist.

Pretty much what I was thinking except for someone actually getting confirmed. If the Obama does put up a moderate I could see the senate confirming just for the reason you cited. I don't see him picking anyone other than a liberal, love to see him prove me wrong.
Our Republican friends on this board must feel so bad. You know, finding out they just lost the presidential elections. So please, start getting used to the idea a "liar" or a "Socialist" is going to run the show. But hey, look at it from the bright side.....at least you get the chance to bitch and moan about everything for another 4 years (at least).
MAl keeps putting out scenarios that assumes the dem nominee has the presidency locked up. (although from what small part of the debate I saw, it may be more accurate than not. F'n romper room bickering, what an embarrassment).
Oh, and everyone can bet there sweet ass if Bern or Hillary is elected and the confirmation has been delayed, it will be one super liberal individual. I'll say again, I think it would be very big of Obama to nominate a moderate on his way out. I'm pretty sure he knows that will probably be his only chance of getting his pick in there.

Why? To do the obstructionists a favor? What have they done the last couple of years to earn their paycheck? Throw every stupid move at Obama they could come up with.........and be proud of it too.

If Obama does nominate a moderate candidate it's not because he wants to make a "big gesture", it's because it's a smart move politically.
Just read an article earlier this morning that stated over the last 100 years, 19 judges were appointed during an election year.Including the one that just died.
