Tom Brady Suspension Upheld

This reminds me so much of the IRS Scandal and Hillary's email server......Presumed guilty if evidence is destroyed. Maybe not in the case of the IRS and Hillary.

DonDiego has come across conformation of his suggestion that the Federal Courts are unlikely to overrule the NFL Commisioner in The Washington Post:

"Opinions vary about what the outcome is likely to be. David Cornwell, an attorney who has represented NFL players in a variety of cases and a former candidate for executive director of the NFLPA, said when asked about Brady’s chances of success in court: 'None.'

The NFL says it properly followed Article 46 of the collective bargaining agreement between the league and union, which outlines the disciplinary process in such cases and, among other things, empowers Goodell or someone designated by him to hear a player’s appeal.

'It appears the process complied with Article 46,' Cornwell said. 'What is granted to the commissioner is absolute authority to protect the integrity of the game. It is a hard and fast rule. He’s obligated to be fair, to not be arbitrary and capricious. You have to show fraud or undue bias to overturn an arbitration. You can’t do that here.'

Cornwell said the evidence allowed Goodell to reasonably conclude that the Patriots and Brady violated the sport’s competitive rules. This week’s revelation that Brady directed that his cell phone be destroyed before he met with league-appointed investigators also works against the quarterback, according to Cornwell."

[Another opinion:]
“ 'It’s very difficult to overturn the arbitration,' [Lawyer] Alan Milstein said. It’s not like you can say the facts didn’t support the ruling. You can’t appeal an arbitration ruling the way you can a court’s decision. But the grounds to overturn an arbitration is, the main ground is it wasn’t fair, that it offends the principles of justice. The main thing anybody could argue in this case is the commissioner shouldn’t have been the arbiter since it was the commissioner’s own ruling that he was arbitrating.' ”

The NFl, the Owners, and the Players all contracted to abide by the rules that do authorize the NFL Commisioner to arbitrate his own ruling. QED

Gold standard!? Maybe at one time, now it's a spiteful owner who's just pissed off his "star" wasn't treated fairly. What owner supports a coach who knowingly videos other teams? And backs up his QB who was knowingly wrong and lied about it? More like a new joke standard.

The gold standards of teams would be the Rooneys, always have been, always will be.

This whole thing is getting absurd. The Pats(once a great org.) now just sounds like a bunch of whiny ass pussys who are throwing a tantrum, the exact same same can be said for Brady's FB post, which I finally read. Sunavabitch already, shut up, take your punishment and get on with football. Never seen a bigger bunch of crybabies in any sport.

According to the NFLPA the biggest fine is $25,000 for altering equiptment. No losing a draft choice....no fines other than $25,000. Who does Goodell thinks he's kidding!
