University of Oklahoma fraternity caught singing a racist chant

Uh-Oh !

It looks like the expulsion of the University of Oklahoma students by the University President may be illegal and, in fact, unconstitutional.
Why? Racist Speech is constitutionally protected.

"Under the First Amendment, though, the government — including the University of Oklahoma — generally cannot add to this price [any negative effects upon the students social and professional lives as a result of their bad behavior], whether the offensive speech is racist, religiously bigoted, pro-revolutionary, or expressive of any other viewpoint, however repugnant it might be."

Uh-Oh! It might be worse than that.

The University of Oklahoma has a Student Conduct Code detailing causes for which students may be disciplined by the school and explicit procedures to be followed when a student is accused of misconduct. There is no listed procedure allowing the school’s president to unilaterally punish any student, let alone expel them.

And there is even Legal Precedent for the University President himself to be held personally responsible for damages to the students for ignoring the established procedures and applying such punishment.

They shoulda listened to poor old DonDiego.

Without commenting on the political aspects of this, I think Clay Travis, who is a sports blogger, brings up very valid points in how OU treats football players vs these frat boys.

Cell phone cameras have changed things.

Pick your nose in public, somebody will put it out there for the world to see.
Or if you are overweight and/or violate fashion rules, and shop at Wal-Mart, or walk the streets anywhere.
Somebody will take you public when you bend over and show some flabby butt.

Does your employer have a "represent us with dignity at all times" clause in your contract?
Beware the cell phone camera should you party a little too hardy.
Your frenemy (friend/enemy) will be only to happy to film you and show the boss.

Agree with DD, that the responsible officials are in a tough place.

If regulations prohibit action against those idiots, so be it, but what they did is OUT THERE, with AUDIO, undisputable, and somebody will pay, now or later.

I agree some of my rant was over the top.
It would be untenable to prohibit future college admission for the boys. I get that.

But it made me sick, and I hope those punks have to answer for their actions in some way.

Beware the cell phone camera next time you scratch in public.

When I was a kid and did something stupid it stayed in the neighborhood. When you were lucky enough to get a girlfriend to pose naked it was taken with a polaroid and stayed in the neighborhood.

Today both examples are spread around the world in a matter of seconds and it is out there for all to see and haunt you for the rest of your lives.

All I can say is be careful, very careful. I do not envy parents trying to raise the young un's in this world.

DonDiego, it is a day that will live in infamy. My future wife, then my girlfriend, comes to the fire station for the first time. This is way back in June of 1980. She asks my captain, which locker is Mikes.

I try to run interference and when she opens my locker what does her gaze fall upon in all of its glory. Yes, you guessed it, the treasured polaroids.

She was none too pleased and made it clear she did not like them. I swore to her I would get rid of them.

Fast forward a couple of months and we are living in bliss (and sin) in our new apartment. Low and behold I am on duty at the station and my future bride to be decides to see what I am studying at the fire academy. Lo and behold when she opens my text book from fire tactics and strategy class what does she see.

Much to my dismay when I returned from saving lives and property I destroyed them.

There have been no new photos in my three decades of marriage and quite frankly I can say I made the right choice.

I don't think scanners had been invented yet. Back then the only scanners I new were fire and police scanners :>)

BTW I don't think I made it clear there were several different ladies in the polaroid's. None of which were my future wife.
