Would you take $14,460 for Contra Costa shipwreck?

$14,460 compensation


The survivors' are perplexed with having to take this amount or to file a class action law suit and possibly get much more. Would you settle for $14,460 (plus reimbursement for the cruise costs and other expenses)? I think I would settle, but of course it's easy for me say, not having to endure the ordeal, not to mention those that perished as well.
I'm sure the first offer is low ball.
Would be tempting to take that offer and head to Vegas. Figure class action lawsuits will go on for years with the lawyers getting most of it.
"Other expenses" could be the deciding factor. If they really want to settle as many as they can, they may accept some pretty outrageous expense claims. Option is to wait years, so I would feel out the ceiling on expense claims

WHY does a person "have" to join a class action, instead of "going it alone" so to speak.

As for a settlement, that would depend on age and finances. Me, I'd probably take the money. Single in my 60's, the money would look pretty tempting.

But if counseling a family of four, I'd suggest they give long deliberation, explore all the options, and speak with several attorneys, especially is they were fairly well off. Even if it takes a decade to get paid, with young kids, it may pay the college tuition and more. Much more.

And there may be issues down the road. PTSD could rear it's ugly head in a year, or decade.

No need to rush, unless you need the money.



Lawsuits in my opinion have gotten so far out of control, it is almost impossible to put an amount on a claim.
Ok, people were on a ship that had a catastrophic ending. For those that were on a lifeboat within minutes and never looked death in the face, I think $14,+ is a very fair amount.
For anyone who was seriously injured, they most likely should seek their own counsel.
Most folks had the adventure of a lifetime that they can dine out on for years. Probably less stressful than being unemployed and wondering how you were going to continue to make the house payment.
I think I would take the money and head to Vegas.

Now if I was injured or lost a loved one. Or the couple that was rescued a day later from inside the ship.
That would be a whole different situation.

In my class action lawsuits, I was automatically part of the class unless I chose to opt out and "go it alone".

But my lawsuits were settled by a judge after threat of litigation. Usually the party at fault, while admitting not guilt, has agreed to put 2 million dollars in a fund. 1.8 million goes to the lawyers and I get a check for $2. None of them happened this fast, they were all many years removed from when I was "injured".
