Question of the Day - 30 November 2020

Q:

With all the recent problems on the Strip, do any casinos allow concealed carry handguns?

A:

[Editor's Note: We've answered this question, and a number of variations on the theme, several times in the recent past, but it continues to show up -- given the rise in incidents of violence in the Las Vegas tourist corridor. We won't answer it again for a while.]

The gun laws in Nevada mandate that no firearms, neither open carry nor concealed carry, are permitted in airports, schools, courthouses, and correction facilities. Other places, such as casinos, movie theaters, and houses of worship, are in charge of their own gun policies.

And yes, you’re legally permitted to carry, openly or concealed, on private property, even those with No Guns Allowed signs at the entrances. Signs such as those carry no legal weight and the owner can’t force you to disarm.

That said, most casinos don’t permit patrons to be armed when they enter. This has been the policy for many years, so there was no reason to change it after October 1 or in the face of the recent violence. Though it’s not against the law to carry in a casino, if the casino, being private property, asks you to leave and you don’t, you can be arrested for armed trespassing. The same goes for any other private property, such as those with no-gun signs on the doors.

In the past, there was little to no enforcement by the casinos. So though officially you weren't allowed, unofficially, you were. And for the most part, that's still true. These days, however, some casinos are using metal detectors at entrances.

Otherwise, in Las Vegas, weapons screenings occur for the most part at sporting events, concert venues, and wherever else there might be a need for a security checkpoint. Beyond that, it’s “sight-security” — in other words, someone openly carrying would probably be asked to leave, but there’s no way of knowing who’s carrying concealed (the whole point of CCW), unless of course that person is forced through a metal detector or presents his or her weapon for one reason or another.

    BAC
I remember reading in the past that you could carry but your blood alcohol concentration had to be less than .10. Any comments?

    Zero is the limit
if you carry a weapon your BAC should be ZERO!

    Dumbed down answer
NO! The answer is NO! Get It stupid, the answer is NO!
If you are dumb enough to reveal your CONCEALED weapon you will be arrested idiot! All of the previous answers didn't get this fact through your thick skull so do yourself a favor and stay out of Las Vegas and Nevada as a whole. In fact, just rescind your CCW privileges since you don't comprehend them at all.

To the rest of the QOD readers I said what the LVA was way too polite to say for obvious legal complications but I'm tired of idiots like this interrupting our daily reading with stupid questions answered repeatedly already but lacked the comprehension to understand the answer.

    CCW
Jackie, you are mostly correct. You are NOT ALLOWED to show your weapon, that is brandishing, and is not allowed. You can TELL security that you are carrying, and NOT show it to them even if they ask you to. DO NOT SHOW IT. Security can ask that you check your weapon into a safe deposit box at the site, if they so choose, or they can ask you to leave and come back without your weapon. Some casinos now have metal detectors at the doors, and some are scanning luggage. If they think you are a threat, and you cannot show that the metal detector is pinging for another reason, they can and usually will ask you to leave. If you do not, then you can be arrested. I do not know if there is an "armed trespassing" if you are carrying legally and have not brandished your weapon. You are just trespassing. And Jackie is also right, if you do not know and understand this, stay home and give up your CCW, cause you are too stupid to have one.

    CCW
Forgot to add, if they ask you to show them your CCW permit, you can do that. It probably will not help get you in, but at least you will not be arrested for carrying concealed without a permit.

    For Donzack and Martin
I'll answer your question and/or statement this way as both of you are "SEMI" correct. The real issue is diminished capacity. The same logic as applied to a DUI. Driving under the Influence of a drug or alcohol is the same reasoning applied to carrying a weapon either openly or concealed.

If you exceed the legal limit for alcohol and carrying a weapon under either legal means will get you arrested. If you are on any drug, legal or otherwise that diminishes your capacity while carrying a weapon, you will be arrested.

Is that clear enough for you two?

    Zero is the limit
Jackie, any consumption of alcohol diminishes your capacity. Is Zero Clear enough for you? Have you ever taken any CCW class?

    What’s legal
It’s not a question of what we think is right but what is legal. I think this is an old law. That’s why I brought it up. Guns can’t do anything wrong on their own.

    Gun love!
Uhhh, let's see. Allow wacko gun yahoos into the casino, packin' heat. Then they get drunk--a little or a lot. They lose. They get angry. Someone at third base takes the dealer's bust card. Somebody gets their hands hit by the dice--seven-out. A hot dealer beats Gun Boy eight hands in a row. Somebody laughs at Gun Boy's cowboy hat or biker jacket.

    What could possibly go wrong?

  • Jackie Nov-30-2020
    Dear Terrance Martin
While I understand your vehement attitude and feel put upon to once again clear your thinking with facts instead of prejudice and bigotry. First of all, I have never been out of possession upon my person of a handgun since the age of 21 and that has saved my life upon numerous occasions. Once narrow minded idiots pushed for gun laws instituting Concealed Carry Permits to carry a firearm but under extremely strict conditions that were almost never granted I was always awarded such a permit and have held several in many different States including my current one in Nevada surrendering my California one. So to answer your question, YES, I have taken many CCW classes.

    Second of all, shut up and read;
NRS 202.257  Possession of firearm when under influence of alcohol, controlled substance or other intoxicating substance; administration of evidentiary test; penalty; forfeiture of firearm.
