Question of the Day - 20 December 2019

Q:

How did the court case turn out for the Hogs and Heifers on November 11? Can’t find any results on Google.

A:

We’re still a long ways from a definitive verdict, but Judge Elizabeth Gonzalez of the Eighth Judicial District Court issued a preliminary injunction barring Hogs & Heifers’ landlord from evicting the biker bar. Hogs & Heifers was appealing a September 30 cease-and-desist notice that attempted to put a gag on any public comments by the owner of the bar, particularly with regard to the eviction notice.

The dispute between the Downtown Grand and bar owner Michelle Dell nearly scuppered Hogs & Heifers’ annual 9/11-tribute parade, and Dell says she has been forced to reschedule and relocate several charity events due to the ongoing unpleasantness. For its part, the Downtown Grand accuses the bar of creating an unsafe environment in the area.

Judge Gonzalez remanded the eviction issue to an early 2020 trial date, the exact schedule to be set at a December 17 preliminary hearing (about which haven't seen any coverage yet).

The Downtown Grand also lost its motion for an injunction barring Hogs & Heifers from making statements to the media or updating followers of the case via social media.

So while we don’t have a final determination of the case, we can report with confidence that all the early rounds have gone to Hogs & Heifers.

    What's the problem?
Does anyone know what the underlying issue is between the Downtown Grand and the bar (Hogs & Heifers)? Have there been fights, shootings, police calls, etc? When the Downtown Grand allowed the biker bar to open & operate on the property surely they were aware of what they were getting into? The bar must be paying it's rent, otherwise that would be grounds for eviction. Perhaps the Downtown Grand feels they are losing too much casino, hotel and restaurant business from customers that don't want to be around the crowd that the bar attracts?

    Awful tenants
The sole issue is that H and H doesn't stay within its boundaries. They held a biker "parade" that blocked traffic in the immediate area and kept foot traffic away. They routinely shout at people on the street through megaphones to try to get them to come into the bar, often using offensive language. In the six months prior to the eviction notice, there were over 30 incidents of disturbing the peace, assault, and indecent exposure in the block adjacent to the bar.

Bikers are not the sort of people you want around--especially drunk bikers. The Grand made a huge blunder in leasing the space and now they're having trouble prying them loose. Hogs and Heifers is a horrible tenant, and if you've ever owned property and had such a tenant, you know that it might take plastic explosives to get them out of there. I'm sure the Grand's business, which depends heavily on foot traffic, is suffering because of it.

    Hogs & Heifers
It seems that the owners of Hogs & Heifers might be patriotic Conservatives. I have only heard good things about them throughout the years.

    My favorite bar
I've been to Hogs and Heifers dozens of times in the afternoon and evening and have never witnessed any type of physical violence. The female bartenders use the megaphones from behind the bar to entice people walking by to come in; the noise from the megaphones does not carry far from the entrance. If you are offended by "offensive" language, Las Vegas is not your type of location. I've witnessed a lot worst on the FSE than bad language. I doubt this place is keeping people from going to the DTG; they have many other issues related to how they run their casino.

    Threat?
Hey Kevin Lewis, you said “plastic explosives” to get the bar removed? That sounds like a threat, maybe something the police should look into? Also, those “30 incidents” didn’t just come from H&H, if it did show proof, and if you can’t handle a mega phone and some words because you’re puss stay off 3rd
