Q:

What’s going on with the new building across the road from Wynn? I thought Wynn was building a third one, then realized it wasn't on Wynn property as I got closer. I understand that imitation is the greatest and all that, but why would anyone build their property to look like other property and/or why would the local authority that approves such things do so?

A:

Great minds think alike.

You and Wynn Resorts came to the same conclusion and last December, Wynn sued Resorts World, a subsidiary of international casino giant Genting Group, for trademark infringement over the similarities they perceived between Resorts World and the Wynn — the same curvature to the façade, the same bronze color of the glass panels, even the same horizontal white lines between the panels.

After a little back and forth between the two companies, during which nothing was resolved, Wynn Resorts filed for a temporary restraining order to stop construction of Resorts World altogether.

A District Court judge ordered the two sides to appear at a hearing in late January of this year to discuss the issues.

A day before the scheduled court date, Resorts World and the Wynn settled their differences privately. The Genting Group agreed to make a number of changes to differentiate its design from its across-the-Strip neighbor.

The design changes, as they stand today, include a fair amount of red being introduced into the design, including the sides of the hotel towers. The white horizontal lines are being “erased”; it looks to us like they’re being painted over with black paint. But in the new renderings since the settlement with Wynn, the stripes will be red, as will the vertical divider between the towers and the roof of the entire building.

It would be impossible to change the shape of the building or the color of the glass panels, so in our opinion, the two buildings will always look similar.

Will Resorts World be mistaken for a Wynn extension across the Strip? We won’t know for sure until the new megaresort is completed in late 2020, according to the current schedule. But in our opinion, the red should distinguish Resorts World from the Wynn. Wynn Resorts seems to agree; they signed off on the new design.

    Why?
    The answer gives some interesting details on the controversy but it doesn’t answer the underlying question, “Why would Resorts build a hotel that looks so much like Wynn’s?” It may be impossible to know, but I would curious to hear what you think their motives might have been.

    ... So I don't care. However, I assume there will be big, giant signs with the resort's name on it, so since I'm not illiterate, I'll be fine.

    Wait a minute
    Wasn't the general shape of the Resorts World's buildings part of the original Echelon complex?, I think I saw some of the renderings and the original shape was kind of the same, so, Genting bought the sight with the initial structure allready in it's place. The shape of the building was pre determined by the original Echelon, wasn't it?

    The Wynn is copper in colour and given there is (on a good day) 1-2 bars on cell phones for those staying there, one could conclude it could be a giant faraday cage. The cost of wifi while staying at the Wynn is over $30 per night PER DEVICE used! Seems only logical to make money when your customers can’t get a signal. Could one conclude that the way the design is blocks signal and makes a tonne of cash for the casino in wifi sales?

    The official story of the copper color on the windows is that Steve Wynn originally wanted blue (a suitably dreamy color for a hotel originally named Le Rêve), but blue windows made people inside look terrifying.  So he settled on the classy and now iconic earth-tone finish.  I wouldn't be surprised if there were purposeful EMF-dampening features in the design, however, both incoming and outgoing.  Anybody care to take some specialist equipment to the different casinos to test cell phone signal strength?

    Resorts World is owned by Malaysian owned Genting Group. Wynn and Venetian are big in Asia, so I'm thinking they copied Wynn because of their success and upscale branding. I just hope it isn't a knock off of inferior quality.
