It depends on who the person is, what their role and responsibility is, and whether such a discussion is part of something official or governmental.
It's definitely illegal to influence a public official in such a manner.

He used money that he had obtained from political contributions, but that's not the issue--the issue is that he misrepresented it as "legal fees." That's fraud.
Reporting the hush money payment as legal fees made it look like a business expense--and thus, he didn't have to pay taxes on that $130 grand. It wasn't a business expense at all, though.
