NPR's fact check quotes Donald Trump's justice department - the ones who looked into Hillary and determined she didnt do anything illegal...And the Jan 6 trials got testimony from Trump's own appointed officials.

We don't know if trump declassified those documents as president.
If Clinton as a civilian can have top secret documents without penalty, then so can Trump
Yes, we do know that Trump did not declassify the documents in question because there is a process with formalities that have to be followed to declassify things. There is no evidence that any of these formalities were followed. Beyond that even if we buy that way out there BS, the documents classified or not are property of the US government. That leaves you with theft of US records and obstruction of justice because he certified he didn't have these documents. There is a witness that says Trump instructed him to move these documents once he was served with a subpoena and there is video of that witness moving these documents.
