Is the Texas abortion ban legal?

The RepubliQ Supremes refused to hear a challenge to Texas's new Handmaids abortion ban. However, I've read that that decision alone doesn't validate the law. The Court could be waiting to hear another challenge, possibly from the DoJ.

 

What seems strange to me is that Roe v. Wade validated the right of women to have abortions. I thought that was unequivocal. I'm not surprised at conservative efforts to crush it, but the Court has many times referred to it as "settled law."

 

If any of our sane forum participants know how the legal niceties of this work, I'd be very interested. As for the rest of you:

It is obvious that Kevin suffers with clinical psychosis. 

Well, the judges that came from the Heritage FOundation's pre-vetted list have unanimously punted the emergency request submitted to them by the law's detrtactors.       Ultimately they will have to hear the case and I suspect they will knock it down.    But I dont pretend to know the level of activism from Brett Kavanaugh and AMy Barrett.

 

In the meantime about 80% of  people seeking abortions in Texas abortions will not be served...and there is no exception for rape and incest.    Governor Abbott said he will stop all incidents of rape in his state so that is of no concern.

This has never been an issue I vote on.  I am pro-choice and prefer the laws stay that way - but I am also not a woman, nor do I have daughters or granddaughters.   So its just not something that impacts me in any direct way.  I would prefer women determine the  laws surrounding their own health

 

.....and I'll add this anecdote for what its worth.    I have a friend who was pregnant and excited to have that baby until the doctor came back and said that it would be born blind, severly mentally damaged and likely not to live beyond age 2.     She got an abortion.   I dont recall how far along she was but it was more than 6 weeks.

 

I agree with certain exceptions, such as 1.) rape, and 2.) verifiable medical reasons. The abortion of a viable, healthy fetus should not be allowed if the fetus has a heartbeat. The main reason for the majority of abortions is these women, who find themselves pregnant, don't want to have a child - they want to fornicate without precautions but don' t want to face up to the responsibilties of having/raising a child if they get pregnant- and that is the major reason why these selfish woman want an abortion. It is not about their bodies or health, they just want to fornicate.

This is the motivation and resulting law resulting from a psychotic religous cult in charge of the government.

 Apparently the truth bothers PJ and the "sluts", as PJ defines them. The really remarkalbe thing about what I have said is that everyone knows it is true - they just don't have the guts or humanity to publicly agree. As far as I am concerned, aborting a healthy,viable fetus is just a loophole that has been "legally" utilized to murder.

Please tell us what those verifiable medical reasons would be. 

 

IMO a person values human life in any form (blind, crippled, multiracial), or accepts abortion as a choice of the mother based on a variety of factors including rape and certain medical reasons.  

 

I lean pro choice, whatever the condition of the fetus, as in PJ's example, or whatever the mother's social reasons are.

 

Is the Texas ban legal?  I have no idea, except I fear it sets a precedent.

Just how "pro choice" is one who agrees with the putting to death of a newborn - just because the "law" in some locales says it is "legal" to do so and the so called "mother" says "kill it" after the child is born? Doing that is nothing but murder.

David's broad brush position is in line with the people who passed the law.  I dont feel inclined to argue.

 

Women of Texas and everywhere else should take note and hold their own representaives accountable in the coming elections.   

Stalker disapproves of women "fornicating." I wonder how he feels about blasphemy?
