There is an argument that ships leaving a port of a non-signatory are not under the protection of the treaty. I have not read the treaty so I don't know how valid that argument is.
That being said I still don't think the president has the Constitutional authority to unilaterally set this blockade.

Faulty argument.
The treaty refers to international waters, so that clause (freedom of the seas) doesn't apply to entrances and exits from ports, but it does acknowledge sovereignty over and right to control waters within the twelve-mile limit, whether or not the nation in question is a signatory. So Trump's blockade of Iranian ports is a clear violation of that clause. Iran has sovereignty and control over its coastal waters, up to the 12 mile limit.
A coastal nation is not allowed, however, to deny "innocent passage," not stopping, which applies even to warships. So Iran could not close the Strait if they were signatories. But they're not.
The treaty, though, doesn't say that Iran has sovereignty over the entire width of the Strait, as it's 22 miles wide at its narrowest point. So some are interpreting the situation to be that Iran should allow passage as long as ships keep to the other side of the Strait or obtain permission from Iran to sail through their side.
Of course, the situation could be solved by diplomacy, the easiest approach being to add Iran to the treaty. But diplomacy is the last thing on the Turd's crumbling mind.

And whatever "deal" is reached is going to include revenue for Iran which will make the "1.7 billion Obama gave to Iran" seem paltry.
But none of that means anything. Republicans learned a great lesson from Dick Cheney and Don Rumsfeld:
