Ukraine is using them on their own soil. No Russian civilians are at risk. It would be different if they were using them to bomb Moscow.
The contoversy comes from the aftermath of the war where Ukrainian civilians might come across undenonated bombs that could kill them. And thats legit. And thats a decision their demoratically elected leader is aware of despite going forward.
If there is a controversy it is with his decision, not ours.

The only drag the US has on ammunition is that which comes from pro-Russian congressional members who vote against its supply. But they aren't making them fast enough to meet demand. "The Ukrainians have been burning through in one month what the United States produces in an entire year," says Mark Cancian, a senior advisor at the Center for Strategic and International Studies
