Since when is "sitting at a light" not driving? One's attention is needed to tell when the light changes and when it does, does the person using a cell phone immediately end it's use or will they continue using their cell phone when they resume driving? Face it, as soon as one enters a road, when behind the wheel, driving commences. Pay the fine, you earned it.

Actually, I did hang up the phone when the light turned green, which the deputy admitted in court. I guess I should have looked up "driving"" before I went to court.

I had to go to small claims court on behalf of a client (my client won) and prior to small claims, the same judge heard driving court cases. Two of the drivers were there for cell phone tickets and both said the same thing -- they were calling doctors either because they were not feeling well, or a child was ill. In both cases the judge cancelled the tickets.

In a third "case" the judge asked the driver if they were using the cell phone for an emergency. "Were you calling a doctor?" When she said no the judge gave the fine but also gave the driver time to pay. Here in California the fine is big plus court costs. I don't know exactly, but Ive heard of people paying $300 or more.

There are plenty of laws on the books that don't make sense, it doesn't make them legal.

For my friends in the state of New York: it is against the law to have non-procreative sex which means you can be put in jail for having oral sex and anal sex. (You might even argue that using a condom or any birth control device is non-procreative and therefore illegal.)

I remember reporting on that when I was a reporter in New York. It was used in an attempt to keep Gays from moving into certain communities.

Now, the law might have changed but I wonder if similar laws are on the books in other states?
