The way the law is written. That's the key. Distracted driving can be when you are DRIVING the car and eating,putting on make up and more.
You were NOT driving.
A lawyer must challange the way the law is written.
He/she can attempt to prove that you were not driving distracted.
The first offense in Washington State is $124. The second one will cost you $248. OUCH!
Then,it's lawyer time.


Well I went to court Monday and I met the bailiff of the traffic court out in the hallway. He told me the officer had shown up and was inside the courtroom. Well there went that hope of getting it dismissed. We were finally called into the courtroom, and no one that should have been there was there....like the commissioner or even a clerk. It was now around 8:30 am and the clerk didn't show up until 9:00 am.

They start calling your name and then the officers name. Wouldn't you know it about 6 people got their cases dismissed because the deputy didn't show up. Finally the commissioner showed up and started calling the names again. He said he would take the lawyers cases first. There was one lawyer representing about 4 cases. Now I don't know what the law is regarding speeding, but the lawyer wanted all her cases to be reduced to 55 mph. I mean, even the one that was a 56 mph ticket. Weird!

So they finally call my name and we walk up to the podium. Naturally the officer gets to tell his story first. He gave a very accurate account of the events so when it was my turn I just stipulated that his version was correct. My whole case was going to be on a technicality that I was stopped and not driving like the statute is written. well that didn't work and I was fined $162.

I should mention 2 things. Politeness counts.....at least in this court...so if you get a ticket don't bother to argue with the officer. 2nd, the judge pointed out to me that the Appeals Court of California just reversed a ruling on GPS devices and smart phone GPS devices. You ARE allowed to use them while driving.
Since when is "sitting at a light" not driving? One's attention is needed to tell when the light changes and when it does, does the person using a cell phone immediately end it's use or will they continue using their cell phone when they resume driving? Face it, as soon as one enters a road, when behind the wheel, driving commences. Pay the fine, you earned it.

... I'm sorry you "lost" the case.I would have done the same and asked for a hearing.
