No sense in getting worked up over this tax issue. On the internet you can be whatever you want to. Everything Kell has said about himself can be true or he could be a retired single guy(or girl) living ssi check to ssi check.
I don't know enough about CowboyKell to say whether he is cheating California out of taxes by pretending to live in Tennessee, a state he said last fall he hadn't been to in years. He's clearly sensitive to the question, laughingly referring to himself as a "cheat" in this thread, (totally unprompted by the way), and apparently using the skills of a knowledgable accountant to maintain what sounds to me like a charade. Counting days in the state? Really?

For purposes of California tax, a person is a California "resident" if the person is "present in California for other than a temporary or transtitory purpose". There's also apparently a law that says that if you spend nine months there in a year, you're a Californian.

California is a really nice place to live, no matter what climate you like or what you like to do. The kind of place one could be really proud to be a part of, one that's really come back from some terrible political leadership a few years back thanks to some new leaders and some wise propositions passed by the voters.

Just seems to me that a person who leaves Tennesse for a house he or she owns in Southern California is a resident of California, and ought to have enough respect for democracy to abide by its laws, even its tax laws.

Gotta figure that when Mrs. Kell says "Honey, let's go home" she's much more likely thinking LAX and not MEM.

Does Tennessee not care when its voters don't live there anymore? I thought that was often regarded as voter fraud.

As for taxes, it's California that's may be being cheated, not Tennessee (which, of course, doesn't have an income tax on salaries or wages). Tennessee law doesn't matter to questions about California's right to tax California residents.

Seriously folks, I obey the law. Perhaps I am one of those hated 1 percenters that stretches every law for all they can get. I have been a tight ass all my life. It's how I got what I have.
What you should think about are the crazy ass laws that allow this to take place. I would be the first one to vote for tax reform. I believe that if done properly everyone, including the government, would be better off.
And speaking of voting...Chilcoot brings up a point that has me thinking. I will be looking into the voting laws and how they apply to me.

Oh, and when Mrs. Cowboy says "let's go home" she is almost always talking about Texas!

Of course if Cowboy were trying to cheat the government by using an address he hasn't visited for THREE YEARS, in order to get:

  • higher welfare payments,
  • higher Medicaid benefits,
  • higher unemployment benefits,
  • entry into a higher quality school district,

    ...that would be different, because no gentleman of leisure!

    That last one - parents faking residency to get their children into a better schools. Parents have been arrested and jailed for that one. And the situation under discussion is about California State Board of Equalization laws and rules, and anyone who thinks it's about Tennessee or the IRS is a ninny.

    Unfortunately I can't see the video but I remember seeing a bit about that or something similar. There was an office supply/machine co. (diebold?) that maintained an office in Ireland. with next to nobody in it and claimed that as HQ. They got to defer hundreds of millions in taxes by doing this.

    Seems something could be done about this, but I doubt anything will happen. Even if thye govt tries to do some sort of reform,I suspect there will always be some loophole.
