I am guessing you are right about that. But if a bartender served someone alcohol to the point of incapacitation, and then entered into a contract with that person, I'm guessing the bartender is screwed.

That's probably true, yet still Nevada issues Felony Warrants every day for failing to pay a casino marker...and many of those markers were issued to intoxicated gamblers.

This is an excellent topic, . . , and everyone has an opinion, . . . and a reason to have that opinion.

This is not the first time that this sorta incident has happened.
Does anyone know of a similar case on which a Court Decision has been rendered?

DonDiego agrees with those who have opined:
__that the gambler does indeed owe the marker-debt
__that it is against Nevada Gaming Commission rules to allow an intoxicated player to play

DonDiego doubts:
__that dealing, betting, winning/losing at a blackjack table is a contract
__that lending the intoxicated player money is against the law; he had applied/qualified for the loans when sober, . . . or at least less intoxicated

DonDiego has often seen drunk people playing slots and table games in Las Vegas and elsewhere. The only place in which he observed a falling-down, totally out-of-it drunk was at a small dockside casino in Curacao. By his clothing he was obviously a seaman and at the time capable only of signaling for a hit on every hand until he busted. . . and he eventually ran out of money. DonDiego was sorry for the fellow, but there was a large man on a high chair observing all activity in the casino, and poor little DonDiego was the only other fellow playing at the tables. DonDiego played for an hour or so and left dead-even; he survived the experience and is here to tell the tale.
But DonDiego digresses.

As DonDiego has suggested, . . . this is not the only time a drunk player has sued for his money back. Does anyone know what the applicable statutes/precedents are? If any?

No, I used the right term.
He is not going to get squat. The courts in Nevada will definitely side with the casino industry. They don't want to open up this can of worms.

One important point...A Marker is not considered a loan. You can't get arrested for not paying a loan.

"The purpose of this letter is to request that the Nevada Gaming Control Board (the "Board") initiate a formal proceeding against Harrah's Entertainment, Inc. Watanabe was the highest profile, but it's not on point because Watanabe's indulgence took place over years, not in one binge.
