Conservatives Think This Guy Tripped And Fell

Whoa... Look closer. Nothing that old guy did deserved what happened to him, nor the lack of medical attention by the offending police thugs.

Luckily for him, there were a couple of human Army medics, that are bound to following lawful orders, there to give him 1st aid.

Thats standard procedure, not bad judgement.  ANd that comes right from the black mayor of Buffalo.

 

The officer in front are not suppossed to tend to the wounded.   They are suppossed to keep moving.   Immediately after the man falls you can hear one of the cops call "Medic!"....and moments later one arrived.   The medics are in formation behind the front line cops.    So the personnel did their duties as prescribed.

 

I wont argue its "bad judgement" to be violent with a senior citizen... but that senior citizen did technically assault an officer.   I doubt he'll get much of a settlement.   And again - look at the video I posted in my last post.   Those cops were WAY more violent.   The protestors in that video aren't even asking for a settlment.

 

 

 

 

I think he'll get a settlement, but not a massive one. He did initiate the contact, after all. Not to say he remotely deserved what happened to him, but if NOT confronting the other guy(s) is ever an option, then tort liability is lessened (as opposed to a situation, say, where a cop chases down and beats a protestor who is making no aggressive moves). You have a legal obligation to not initiate a confrontation if you can avoid it.

 

Again, I'm just saying what I think the outcome will be from a legal standpoint. Those cops were dicks, but it seems (despite immediate appearances) that the other cops did what they were trained to do--and to a certain extent at least, the two cops who shoved the guy did what they were trained to do afterward as well.

 

The real outrage is that phalanxes of cops with weapons and armor are marching on peaceful protestors--using the Trump pretext that maybe possibly sorta kinda some of them may get violent.

Somewhere on cop cars it says'' Protect and Serve'', not shove and ignore.


I think the settlement will be large for the following reasons.

 

1. Nationwide negative publicity

2. The severity and visibility of the injury.

3. The fact that officers' own department charged them with felonies.

 

 

If the city takes to it court rather than settles, they are foreclosed from arguing the officers were behaving properly.  They have already admitted in court filings there was probable cause to charge the officers with felonies.  If it goes to trial, it would come down to what damages are appropriate in the case. Showing the jury the video with the blood running out of the guy's ear makes it pretty hard to claim the guy didn't suffer any damages or minimal damages.

 

PJ, if officers are committing felonies assaulting you, you have the right to put your hands up to try and get them to back off. It seems to me he was trying to deescalate the situation.  Again, the cops are supposed to be professionals with training to deescalate situations.  It shouldn't have been up to the old man to calm the angry cops down.

 

 

 

 

 

Whether or not any of these incidents come to light depends on if someone is standing nearby with a smartphone. How much shit goes down and is never recorded and therefore, never sees the light of day?

 

I think the cops are all too often Trump-trained to see the protestors as threats--and when they march upon the protestors in grim-faced battle formation, batons at the ready, they often turn a nonviolent situation into a violent one. It all comes down to whether you see a protestor as a violent (Black) thug or someone exercising his First Amendment rights.

 

I'd also like to observe that most cops are good people and consummate professionals. That makes it all the more imperative to weed the bad ones out.

"Standard procedure" is different during a riot.  People, get the hell out of the way of riot police.  They are not their to make friends, and they don't know who the enemy is.
