That's just it. The debate doesn't move to the states. If the Supreme Court wanted to move the debate to the States they simply would have allowed states to put whatever restrictions on abortion they wanted. However, they decided they wanted to remove abortion as a fundamental right.

 

Why do you think that is? It's so a future Republican Congress and Republican president can enact a nationwide abortion ban. Since it's no longer a fundamental right, it would be perfectly legal for them to do so. Don't fall into the trap of buying the conservative argument that it's a states right issue. They removed it as a fundamental right because they want to pass a nationwide abortion ban.

It's no more a states' rights issue than slavery being illegal is up to the states. SCOTUS overreached their authority. The Supreme Court does NOT have the power to nullify the 14th or any other Amendment; it therefore cannot grant that power to the states.

 

The utter rank hypocrisy here is that this is the same gang that is preventing the states from drafting their own interpretations of the 2nd Amendment, using the polar opposite of the argument they are now using to justify their ruling.

 

SCOTUS is no longer legitimate.

Mark, I'll write slowly.  It's against constitutional law for the federal goverment to dictate anything to the states regarding abortion.  Pro or Con.

The federal government can, should, and does "dictate to the states" on matters of the Constitution. The recent terrible SCOTUS decision does nothing to change that fact.

I think Thats very much wishful thinking.

 

I can envision getting 60 Senators to agree on abortion access....I cant envison 60 Senators banning it at a National Level.     Nevermind how hard it is to get 60 Senators in the frist place - but even if we had 60 Republican Senators they still would have the Susan COllins and Lisa Murkowskis to deal with.    So they would really need more than 60.   

 

And when the polls come out showing how incredibly unpopular it is at a national level Republicans will run away from that issue faster than their attempt to privatize Social Security.      

 

Make no mistake, banning abortion is not a winning issue for Republicans going forward.
