Street "Performers" and Water "Sellers"

A unanimous Supreme Court today struck down a Massachusetts law that required people not entering a business to stay at least 35 feet away from the business' entrance.



The state tried to justify the law on the grounds that the buffer was needed because people were purposefully attempting to harass customers as they attempted to enter the business. The business really wanted the law, but the court said no.
I agree with Chilly that there are plenty is idiot Liberal judges.

I'm surprised that Chilli didn't disclose that this ruling was concerning abortion clinics. In matter of fact, I'm not sure the case was about any other kind of business. I wonder why he/she/it left it out?

Scalia said free speech is free speech and it doesn't matter what the business does; all should play by the same rules. The rules say free speech takes priority of a business' right to not have their customer's harassed.

I'm shocked (no, not really) that Boilerman is not up in arms over this SCOTUS decision that doesn't protect the business owner from those pesky free speech folks.

The question is where does free speech end and harassment begin. Do I have the right to follow Snidely's wife, or mother, or sister everywhere she goes. Morning, noon and night, screaming that she's a nasty person and taunting her. Day after day, week after week, month after month, year after year calling her a pig and telling her that she deserves to die.

If such actions happen to Liberals, they are outraged. If it happens to others, then Liberals argue that it's free speech.

I argue that if a reasonable person can conclude that these "street folks" (creepy people is more accurate) are doing substantial damage to the local businesses on Fremont, then they are harassing people.
