Street "Performers" and Water "Sellers"

Actually if you had read my link you would have learned that we are talking about two different things. Regarding the enforcement on Fremont Street East, The 1300 citations were thrown out because Metro didn't copy the law correctly in the enforcement guidelines....the Cops actually believed all open containers were banned and they weren't. They didn't understand the law because someone didn't write it down correctly.

The bottom line is that is how they are trying to get a handle on the 'punks' you want hauled off. Not because of how they look or what they say...but because of an action...Like drinking where they shouldn't or curfew violation for minors or obstructing traffic. You can't get hauled in for the way you look or how you smell or asking for donations or dancing in the street or wearing a costume. At least not in America. At least not yet.

Outlawing Open Containers isn't really what this discussion is about. My comparison to your demand that Street Performers be hauled away or arrested or cited was simply that it will be thrown out of court too. And it will be a big waste of time and money. Free Speech is protected by the Constitution. Drinking on the street is not protected by the Constitution.

The law stated, in so many words, the "Those walking Fremont East will be ticketed". The cops interpreted the law exactly as written. Judges decided that the law was too broad, and tossed out the tickets. Also, lawmakers realized that the law was poorly written.

Moral of the story, you and I can't walk with a drink because the wimps in Vegas don't have enough guts to kick the punks off of the street. Wimpy Liberal judges are most at fault.

Vegas needs to hire Sheriff Arpaio, the tough ass Arizona guy which would solve these problems in one month. The great thing about his jails is that prisoners do not wish to return.
No none answered the question about the salvation army workers. Do they need to be licansed/have some kind of permit to stand outside Macy's or wherever?

Are you even reading your own links? Your link had to do with the 'THE PROPOSED BRAND NEW LAW REGARDING THE FREMONT STREET EXPERIENCE' That means under the canopy....not Fremont Street East.

The law my link referred to was regarding FREMONT STREET EAST and the 1300 citations that were handed out over a year ago and then ALL dismissed because Metro had transcribed the law wrong. It might help the conversation if you actually read the stuff that you're commenting on.

The real moral of the story is you don't seem to respect the 1st Amendment..and it's probably a good thing that you aren't in a position of power, because there is no doubt you would abuse that authority....as you are continually suggesting.

If they are on public property, they are exercising their 1st amendment rights. You typically don't need a permit to exercise a right. Some states require Non-Profits to register if they are going to be soliciting funds...but that's different than forcing you to get a permit to ring the bell on a corner. I imagine Management of the Fremont Casino and Boiley would kick out the creepy bell ringers if they could. Every penny that goes in the kettle is penny that could be going into a slot machine.

Water peddlers are operating illegally and will get ticketed if caught. Street performers I barely notice. I've heard some can be pretty aggressive demanding tips if you take a picture with them. Just because they are out "earning a living" doesn't mean they aren't on public assistance. They certainly aren't reporting any income from there activities. I'm all for free speech so if the Constitution protects them that settles it for me. The Supreme Court just unanimously struck down a Massachusetts law that tried to limit the free speech rights of those protesting against a woman's right to murder her own child. Thanks SC. But, I don't pick and choose what free speech I want to see tolerated based on my personal beliefs.

Who should have the most concern about these folks on Fremont Street? I suggest that would be the business owners on Fremont Street. Since all rights should be considered, and if these nuts are chasing away business............for whatever reason........we should consider the rights of the owners.

Most Liberals don't believe that business owners should have any rights, however.
I agree with your statement about the performers adding "character", yet I do not believe it's good character. If it is true that these folks are chasing away business, do the owners have no recourse? What about if it gets so terrible that 90% of downtown closes down? Is it then acceptable to close these folks down.
