Anyone Ever Get Out Of a Cell Phone Ticket?

I agree with you Bagiant. I see no harm in using your phone while sitting at a light. If I were you I would cancel my donation this year. Make sure you let them know why too. Around here, it is not uncommon to see police driving around with their eyes glued to a dash mounted laptop. I don't see how that isn't considered dangerous.

Except that it is still against the law. Heck, maybe I have an open bottle of booze between my legs while I am driving (against the law where I live.) I am not drinking and driving. I just have an open container.

Believe me, I weighed heavily whether or not I should chime in, because I like reading the OP's comments. However, the law is the law. Don't like it...Vote to change it. (NB: I don't own a cell phone, therefore, I am never tempted to use one in the car while driving.)

Exactly, it is against the law, but Bags still thinks he did nothing wrong. There are plenty of laws on the books that don't make sense, it doesn't make them legal.

Police also speed and go through red lights when on an emergency call.

That along with looking at a dash mounted laptop is part of what they are TRAINED to do safely at the Police Academy, and even after.

People forget that the Badge and the Patch gives them justified authority to do these things.

I'm always polite to the officer. But this law was put in affect because of people being distracted by taking their phone calls. When you're STOPPED you are NOT being distracted by any means. This is only a way to take in revenue for the state or local municipality. I just don't agree with the statute the way it is written....which I'll find out when I go to the law library. It never hurts to plead not guilty anyway as the officr may not show up for court. I've seen that happen many times.

I think you are going to find out that you will be found guilty as the law is written. I would probably just pay the fine and move on, but that's just me.
I think the cell phone and texting fines are progressive, meaning if you get caught more than once committing the infraction, the fine goes way up.

People sleeping off their drunk in parked cars, but not actually driving, get convicted of drunk driving.

People loitering outside schools with marijuana or meth packaged for sale, but not actually selling, get convicted on drug charges.

People who try to board airplanes with bombs in their shoes, but not actually blowing up a plane, get convicted on terrorism charges.

You're going to continue to have a hard time in this life if you keep having no idea how things work.
Let's pass the hat and collect money for a Bluetooth for Bagiant. You will love it!
I'll contribute to the commissary fund if/when he is convicted, and sent to prison. Or jail.

BTW: The Gray Bar Hotel has no resort fees.

I would just like to see the judge make him admit he broke the law.
